If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy

23. We undertake to take all due care with any information including Comments which you may provide to us when accessing our website. However, we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.

Modern Commercial Solar Financial Incentive

25. Government financial incentive is based on a 100kW Solar Array installed in Zone 3 which qualifies for STC’s (1658 STC’s) under the Renewable Energy Target (RET).
26. STC values are subject to market price variations and the discount is subject to change based on these variations.
27. Example of a qualifying financial incentive is based on a 100kW solar system qualifying for 1658 STC’s = $56,000. ($33.77/STC).

Warranty

2.2.10 A standard minimum retailer’s warranty period of five years1 on the operation and performance of the whole solar PV system, including workmanship and products, must be provided to the consumer by the Signatory.

(a) That retailer’s warranty exists over and above the consumer’s rights under consumer guarantees in ACL.

(b) The consumer is entitled to claim a remedy if the goods or services do not meet a consumer guarantee or retailer’s warranty.

(i) The Signatory must implement warranty repairs or replacements within a reasonable timeframe.

(ii) The consumer is not entitled to a remedy when the Signatory does not meet

a consumer guarantee (statutory and retailer’s warranty) due to something:

  1. someone else said or did (excluding the Signatory’s agents or employees); or
  1. beyond human control that happened after the goods or services were supplied (for example, force majeure events, possums, extreme weather).

1 This warranty period is the minimum applicable to the service component of installation and all products (inverters, panels, electrical components etc.). Certain products, for example, panels and inverters, might have a warranty that exceeds five years.

Consumer Complaint/Resolution Procedure

INTRODUCTORY

The Modern Group prides itself on the service and products we produce, and our aim is to make the Modern Brand a household name that holds confidence and respect.

Whilst The Modern Group’s promise is to provide service and product excellence there may be occasions where unforeseen situations may arise which challenge the relationship between The Modern Group and its consumers. It is these circumstances that The Modern Group step it up and work with the consumer to resolve these issues in a timely manner and with absolute professionalism.

The Modern Group has developed a Consumer Complaint/Resolution Procedure which consumers can follow to aid them in resolving the issue they have and without feeling that they will not be heard.

Employees of The Modern Group are to comply with the Consumer Complaint/Resolution Procedure and ensure that all consumer complaints are dealt with in a speedy and timely manner given respect to each circumstance.

PROCEDURE – SALES

The procedure for a consumer to follow can be broken into stages;

Step 1. As soon as possible contact The Modern Group via telephone call, letter, or filling out and submitting the online Customer Complaint Form. 

If by telephone call, you will be put through to the Customer Service Manager and explain the problem you have experienced and the outcome you are seeking.

If by letter, your correspondence will be issued to the Customer Service Manager who will investigate and ring you back within 48 hours of receiving the letter.

If by the online Customer Complaint Form, you will need to fill out and submit a fully completed Customer Complaint Form which can be found at www.moderngroup.com.au/about-modern/customer-complaint-form  and which will be issued to the Customer Service Manager who will investigate and ring you back within 48 hours of receiving the online Customer Complaint Form.

Sometimes a simple call may be the only requirement to resolve the issue. All details of the complaint will be noted in The Modern Group’s Data Base which is where a record of the complaint and how it will be treated is stored. This will remain in the Data Base until the issue has been resolved, upon receival of a signed Consumer Complaint Resolution Form.

The Customer Service Manager will be able to determine the process that will be taken in order to resolve your complaint if the problem cannot be resolved by a phone call the Customer Service Manager will pass your enquiry on to the Sales Manager/Advertising Manager.

Step 2. The Sales Manager/Advertising Manager will review your complaint and advise on the method that will be taken to resolve the problem in a timely manner.

In circumstances that relate to a Sales Consultant’s conduct the Sales Manager will consult with the Sales Consultant and address the problem and provide a solution.

In circumstances that related to a Telemarketing Call the Advertising Manager will consult with the telemarketer and address the problem and provide a solution.

If a resolution to your complaint has been reached you will be asked to complete the consumer complaint resolution form confirming your satisfaction and that the problem has been resolved. The Modern Group asks that you email this to consumersupport@moderngroup.com.au.   

Step 3. In the event that you are dissatisfied with your complaint handling procedure and require further information or direction, write a letter addressing it to the General Manager and Compliance Manager detailing your complaint and the process you have experienced, this will be escalated to High Priority Resolution within 7 days given the circumstances of the complaint. The Modern Group asks that you email this to consumersupport@moderngroup.com.au or post to the Modern Group Address.

Step 4. The customer must be kept informed constantly throughout the investigation process and must be contact at least every 7 days.

In cases where the problem is minor the installer may be able to fix the issue on the spot, you will be then asked to sign your satisfaction of the service/warranty as confirmation that your problem has been resolved.

If the problem is deemed major the Production Manager will arrange a time with you to inspect the installation to assess the problem and provide a solution.

Once a resolution to your complaint has been reached you will be asked to sign the service/warranty form confirming your satisfaction and that the problem has been resolved.

Step 3. In the event that you are dissatisfied with your complaint handling procedure and require further information or direction, write a letter or email addressing it to the General Manager and Compliance Manager detailing your complaint and the process you have experienced, this will be escalated to High Priority Resolution within 7 days given the circumstances of the complaint.  The Modern Group asks that you email this to consumersupport@moderngroup.com.au or post to The Modern Group Address.
